1. Service Overview

The Service allows you to:

• Purchase merchandise, digital products, and memberships (“Memberships” and collectively, “Products”);
  
  

• Access content and updates shared by Creator; and
  
  

• Participate in Creator’s community offerings.
  
  

Merchant of Record: For all purchases of Products and Memberships, Fourthwall, Inc. (“Fourthwall”) is the seller of record. Transactions are processed by Fourthwall. Creator is responsible for delivering Membership benefits and for fulfilling any self-fulfilled products.

2. Eligibility

You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant that:

• You are at least 13 years old (and if under 18, you have parental consent);
  
  

• You have not previously been suspended or removed from the Service; and
  
  

• Your registration and use of the Service complies with all applicable laws.
  
  

3. Accounts and Registration

To access Memberships or certain features, you must register for an account. You agree to provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at contact@support.ohheyvoid.com if you suspect unauthorized use.

4. Payments and Memberships

4.1 Pricing
Creator may determine pricing for Products and Memberships. Prices may change, and promotions may apply to some customers but not others.

4.2 Authorization
You authorize Creator, Fourthwall, and their third-party payment processors to charge all sums for purchases and Memberships to your payment method.

4.3 Recurring Memberships
Memberships may include recurring billing. By purchasing, you authorize automatic charges until canceled. To avoid future charges, you must cancel before the renewal date. Cancel via your account settings or by contacting contact@support.ohheyvoid.com.

5. Shipping, Returns, and Refunds

5.1 Fourthwall-Fulfilled Products
Fourthwall is responsible for sourcing, shipping, and handling defective returns of Products it fulfills. Fourthwall accepts returns of defective Products within 30 days of purchase and issues refunds directly. See Returns & FAQs

5.2 Self-Fulfilled Products
If Creator fulfills Products directly:

• Orders must ship within 14 days, with valid tracking provided.
  
  

• Creator is responsible for timely delivery and handling disputes/chargebacks.
  
  

• Failure to fulfill may result in order cancellation or withheld payouts.
  
  

5.3 Non-Defective Returns
Returns of non-defective Products are generally not accepted. If Creator requests Fourthwall to issue such refunds, Creator is responsible for the costs.

5.4 Shipping Costs
 Shipping fees are displayed at checkout. If free shipping is offered, Creator covers the shipping costs.

6. Membership Benefits

While Fourthwall processes Membership sales, Creator is solely responsible for providing the Membership benefits described on the Creator Site. Which are subject to be updated at any time at the creator’s discretion. 

7. AI Generated Content Disclosure

Some of the content, products, or media on our website, including text, images, and audio, may be generated or enhanced using artificial intelligence (AI) tools. We use these tools to rapidly prototype, create, and share our projects. While we strive for accuracy and creativity, AI-generated content may occasionally include artifacts or inaccuracies. We encourage users to engage with this content with an understanding of its AI-generated nature. By using the Service, you acknowledge and accept this.

8. Submitted Content

As a user or member of the Site, you herein acknowledge, understand and agree that all information, text, software, data, photographs, music, video, messages, tags or any other content, whether it is publicly or privately posted and/or transmitted, is the expressed sole responsibility of the individual from whom the content originated. In short, this means that you are solely responsible for any and all content posted, uploaded, emailed, transmitted or otherwise made available by way of the Indie Mutt Services, and as such, we do not guarantee the accuracy, integrity or quality of such content. It is expressly understood that by use of our Services, you may be exposed to content including, but not limited to, any errors or omissions in any content posted, and/or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available by Indie Mutt.

• a) uploading, posting, emailing, transmitting, or otherwise making available any content that shall be deemed unlawful, harmful, threatening, abusive, harassing, tortious,

• defamatory, vulgar, obscene, libelous, or invasive of another's privacy or which is hateful, and/or racially, ethnically, or otherwise objectionable; 

• b) causing harm to minors in any manner whatsoever; 

• c) impersonating any individual or entity, including, but not limited to, any Indie Mutt officials, forum leaders, guides or hosts or falsely stating or otherwise misrepresenting any affiliation with an individual or entity; 

• d) forging captions, headings or titles or otherwise offering any content that you personally have no right to pursuant to any law nor having any contractual or fiduciary relationship with; 

• e) uploading, posting, emailing, transmitting or otherwise offering any such content that may infringe upon any patent, copyright, trademark, or any other proprietary or intellectual rights of any other party; 

• f) uploading, posting, emailing, transmitting or otherwise offering any content that you do not personally have any right to offer pursuant to any law or in accordance with any contractual or fiduciary relationship; 

• g) uploading, posting, emailing, transmitting, or otherwise offering any unsolicited or unauthorized advertising, promotional flyers, "junk mail," "spam," or any other form of solicitation, except in any such areas that may have been designated for such purpose; 

• h) uploading, posting, emailing, transmitting, or otherwise offering any source that may contain a software virus or other computer code, any files and/or programs which have been designed to interfere, destroy and/or limit the operation of any computer software, hardware, or telecommunication equipment; 

• i) disrupting the normal flow of communication, or otherwise acting in any manner that would negatively affect other users' ability to participate in any real time interactions; 

• j) interfering with or disrupting any Oh Hey Void / Indie Mutt LLC Services, servers and/or networks that may be connected or related to our website, including, but not limited to, the use of any device software and/or routine to bypass the robot exclusion headers; 

• k) intentionally or unintentionally violating any local, state, federal, national or international law, including, but not limited to, rules, guidelines, and/or regulations decreed by the U.S. Securities and Exchange Commission, in addition to any rules of any nation or other securities exchange, that would include without limitation, the New York Stock Exchange, the American Stock Exchange, or the NASDAQ, and any regulations having the force of law; 

• l) providing informational support or resources, concealing and/or disguising the character, location, and or source to any organization delegated by the United States government as a "foreign terrorist organization" in accordance to Section 219 of the Immigration Nationality Act;

• m) "stalking" or with the intent to otherwise harass another individual; and/or 

• n) collecting or storing of any personal data relating to any other member or user in connection with the prohibited conduct and/or activities which have been set forth in the aforementioned paragraphs.

Oh Hey Void / Indie Mutt LLC herein reserves the right to pre-screen, refuse and/or delete any content currently available through our Services. In addition, we reserve the right to remove and/or delete any such content that would violate the Terms or which would otherwise be considered offensive to other visitors, users and/or members.

Oh Hey Void / Indie Mutt LLC herein reserves the right to access, preserve and/or disclose member account information and/or content if it is requested to do so by law or in good faith belief that any such action is deemed reasonably necessary for:

• d) responding to requests for customer service; or

• d) the contributor's Contributions shall automatically become the sole property of Indie Mutt; and 

• e ) Indie Mutt is under no obligation to either compensate or provide any form of reimbursement in any manner or nature.

14. Disclaimers and Limitation of Liability

The Service and all content are provided “as is.” Creator and Fourthwall disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

To the fullest extent permitted by law:

• Creator and Fourthwall are not liable for indirect, incidental, or consequential damages.
  
  

• Aggregate liability is limited to the greater of (i) $100 or (ii) the amount you paid in the 12 months before the claim.
